Trust Law No.3 Here Comes “the Declaration of Trust”

Last October, a Declaration of Trust has come up to my office from California, and with the pour-over will.
There was a certain challenge to preparing for registration procedure of the real property located in Japan.
I am all set for probate and registration, except for amendment of the decedent’s death certificate.

In order to amend the death certificate, one brother and one sister of the decedent swore in the affidavit, signed and submitted it through the testamentary executor to the Vital Records Department of the State in California.
But, this application was rejected only because two signatures were not in English.
They were in Japanese.
It might be because that their Affidavit for amendment is filed and end up in the part of the California official documents.
If this is the case, they should give us preliminary advice. We lost 6 weeks.

I would like to write details of this registration case “declaration of trust & pour-over will” in some form or other after the registration completed.
